SMQHT SESSION TERMS, CONDITIONS & INFORMED CONSENT
These Terms, Conditions & Informed Consent (“Terms”) apply to Soul Memory Quantum Hypnosis Technique™ sessions provided by Melisa Noel through Angels & Earthlings (“Provider,” “Practitioner,” “Melisa,” “I,” “me,” or “my”).
By booking a session, submitting payment, and checking the acknowledgment box, you (“Client,” “you,” or “your”) confirm that you have carefully read, understood, and voluntarily agreed to these Terms.
1. About SMQHT
Soul Memory Quantum Hypnosis Technique™ (“SMQHT”) is Melisa Noel’s framework for spiritual exploration, soul-memory work, guided hypnosis, past-life regression, Life Between Lives exploration, Higher Self connection, and related consciousness experiences.
Depending on what naturally arises during your session, your experience may include past-life material, current-life memories, symbolic or archetypal experiences, spiritual-realm experiences, encounters with guides or other beings, nonhuman or nonphysical experiences, energetic or frequency-based experiences, Higher Self communication, emotions, physical sensations, thoughts, impressions, sounds, imagery, intuitive knowing, or other forms of inner awareness.
There is no requirement that you see clear mental images. Clients may experience the session visually, emotionally, physically, intuitively, conceptually, energetically, or through an internal sense of knowing.
The Practitioner cannot control or guarantee what you will experience, where your awareness will go, what information will arise, or whether you will access a specific lifetime, being, memory, answer, or spiritual experience.
2. Spiritual and Personal-Development Service
SMQHT is offered as a spiritual exploration, consciousness-exploration, educational, and personal-development experience.
The Practitioner is not acting as your physician, psychologist, psychotherapist, psychiatrist, licensed counselor, social worker, attorney, financial advisor, or other licensed healthcare or professional-services provider.
SMQHT is not medical care, mental-health treatment, psychotherapy, trauma therapy, diagnosis, crisis intervention, or a substitute for services provided by an appropriately licensed professional.
Nothing discussed, experienced, interpreted, or suggested during a session is intended to diagnose, treat, cure, or prevent a physical or mental-health condition. The session should not be used as a substitute for medical examinations, mental-health care, prescribed medication, legal advice, financial advice, or other qualified professional support.
You agree not to discontinue, reduce, increase, or otherwise alter medication or professional treatment based solely on information received during a session. Any medical or mental-health decisions must be discussed with an appropriately licensed provider.
3. Emergency and Crisis Situations
SMQHT is not an emergency or crisis service.
You should not book or rely upon a session if you are experiencing an immediate medical emergency, suicidal crisis, risk of harming yourself or another person, active psychosis, or another condition requiring urgent professional care.
In an emergency, contact 911, local emergency services, a crisis-support resource, or an appropriately licensed healthcare professional.
4. Client Eligibility and Responsibility
You must be at least eighteen years old and legally capable of consenting to the session.
By booking, you confirm that:
If you have questions about whether hypnosis or an emotionally immersive spiritual practice is appropriate for you, you agree to speak with a qualified healthcare or mental-health professional before participating.
The Practitioner may request additional information, recommend professional clearance, decline a booking, postpone a session, or end a session when she reasonably believes proceeding may be unsafe, inappropriate, outside her scope, or unlikely to support the Client.
5. Voluntary Participation and Personal Control
Hypnosis does not remove your agency or personal control. You remain capable of speaking, thinking, making decisions, withholding information, rejecting a suggestion, requesting a change, and ending the session.
You may pause or stop the session at any time.
You agree to communicate if you feel unsafe, excessively distressed, physically unwell, unable to continue, or uncomfortable with the direction of the session.
The Practitioner may also pause or end the session if continuing appears unsafe, inappropriate, unproductive, or outside the intended scope of SMQHT.
6. Subjective Nature of Session Experiences
All experiences arising during SMQHT are subjective.
Material may be experienced as literal, spiritual, symbolic, metaphorical, imaginative, intuitive, archetypal, energetic, subconscious, emotional, or some combination of these. Different clients may interpret similar experiences differently.
The Practitioner does not represent, warrant, or certify that any image, memory, statement, identity, date, location, lifetime, spiritual being, Higher Self communication, or other experience arising during the session is historically accurate, scientifically verified, objectively true, or evidence of an event that occurred in physical reality.
SMQHT is not a truth-detection method. Hypnosis should not be treated as a lie detector, forensic process, investigative interview, or guaranteed method of recovering accurate factual memories.
You agree not to rely solely upon session content to:
Any information that may affect another person or lead to a major real-world decision should be approached carefully and independently corroborated through appropriate evidence and qualified professional guidance.
7. No Guaranteed Outcome
Individual experiences and outcomes vary.
The Practitioner does not guarantee that you will:
Some clients experience vivid and detailed material. Others experience subtle impressions, emotions, body sensations, thoughts, energetic awareness, darkness, partial information, or a quiet and restful state.
A session will not be considered unsuccessful solely because it differs from your expectations.
Testimonials, client stories, social-media content, and descriptions of previous sessions represent individual experiences and do not promise that you will receive the same results.
8. Possible Emotional and Physical Responses
SMQHT may bring forward emotionally intense, unfamiliar, surprising, or uncomfortable material. You may experience sadness, fear, grief, anger, confusion, fatigue, vulnerability, emotional release, physical sensations, temporary distress, or a need for additional integration afterward.
Other temporary responses may include headache, dizziness, nausea, sleepiness, changes in sleep, heightened emotions, or feeling mentally or energetically sensitive following the session.
You voluntarily accept the possibility of these responses.
You are responsible for arranging any support you may need after the session. This may include rest, hydration, journaling, grounding practices, trusted personal support, or care from an appropriately licensed professional.
If distress continues, intensifies, interferes with daily functioning, or raises concerns about your physical or mental health, you agree to seek appropriate professional support.
9. Session Format and Preparation
SMQHT sessions are generally conducted virtually through Zoom and typically last approximately two and one-half to three hours. This ordinarily includes an initial conversation, approximately two hours of guided hypnosis, and a short debrief. Session length may vary depending on the Client’s experience and the Practitioner’s professional judgment.
You agree to:
The Practitioner may postpone, shorten, or decline to begin a session if your environment does not offer sufficient privacy, safety, audio quality, or freedom from interruption.
10. Payment and Booking
Full payment is required to reserve your appointment unless a different written payment arrangement has been approved.
Your appointment is not confirmed until payment has been received and all required booking steps have been completed.
Session fees cover the reserved appointment time, preparation, intake review, the live session, and delivery of the available recording. Payment does not purchase or guarantee a particular spiritual experience, result, revelation, answer, or outcome.
11. Cancellation and Rescheduling
You may reschedule your appointment one time by providing at least forty-eight hours’ written notice.
Cancellations or rescheduling requests made with less than forty-eight hours’ notice are nonrefundable and may result in forfeiture of the session fee.
Failure to attend your appointment without notice will be treated as a no-show, and the session fee will be forfeited.
Additional rescheduling requests may require a new booking and payment at the Practitioner’s discretion.
If you arrive late, the Practitioner may shorten the session so that it ends near the originally scheduled time. Arriving more than fifteen minutes late without communication may be treated as a no-show.
Exceptions may be considered for genuine emergencies but are not guaranteed.
If the Practitioner must cancel or reschedule, you will be offered a replacement appointment. If a reasonable replacement cannot be arranged, the amount paid for the undelivered session will be refunded.
12. Technology Interruptions
Virtual sessions depend upon functioning devices, internet connections, audio equipment, software, and third-party platforms.
If the connection is interrupted, both parties will make a reasonable effort to reconnect and continue.
If a significant interruption results from the Practitioner’s technology and the session cannot reasonably be completed, the Practitioner may extend, reschedule, or provide another reasonable remedy.
If the session cannot be completed because of the Client’s equipment, connection, environment, lack of privacy, failure to prepare, or repeated interruption, a refund is not guaranteed. Any rescheduling will be at the Practitioner’s discretion.
The Practitioner is not responsible for outages, platform failures, device malfunctions, corrupted files, internet disruptions, or other circumstances outside her reasonable control.
13. Session Recording
SMQHT sessions are recorded so that you can listen to your session afterward.
By accepting these Terms, you consent to the audio and, where applicable, video recording of your session for the purpose of providing the recording to you.
The recording is intended for your private, personal use. You may request that recording be paused or stopped at any time. If you decline or stop the recording, you understand that some or all of the session may not be available for later delivery.
The Practitioner will make a reasonable effort to create and deliver a usable recording, but a flawless or complete recording cannot be guaranteed. Technical issues may occasionally affect the sound, video, length, quality, or availability of the file.
The Practitioner is not required to repeat or refund an otherwise completed session solely because the recording is incomplete, corrupted, unavailable, or affected by circumstances outside her reasonable control.
When a recording or download link is provided, you are responsible for downloading it promptly and creating your own backup. Download links may expire, and the Practitioner does not promise to archive recordings indefinitely.
Unless you provide separate promotional consent, your recording will not knowingly be published, sold, publicly shared, or used in promotional content.
14. Client Recording and Distribution
You may retain the recording provided to you for your private use.
You may not sell, license, teach from, publicly upload, broadcast, distribute, reproduce, edit into public content, or commercially use the session recording without prior written permission.
You may not use the recording, session structure, scripts, questions, processes, or Practitioner’s materials to train others in SMQHT or represent yourself as authorized to teach or certify the modality.
15. Confidentiality and Privacy
The Practitioner will make reasonable efforts to protect your personal information, intake materials, session details, and recording.
Confidentiality cannot be guaranteed in every circumstance. Information may be disclosed:
Virtual communication and digital storage carry inherent privacy and cybersecurity risks. Although reasonable precautions may be used, no internet transmission, email, cloud-storage system, video platform, or digital recording system can be guaranteed completely secure.
The SMQHT relationship is not represented as a physician-patient, psychotherapist-patient, or attorney-client relationship. Communications may not receive the same legal privilege or statutory protections that apply within those professional relationships.
The Practitioner does not represent that Angels & Earthlings is a HIPAA-covered healthcare provider or that session information constitutes a HIPAA-protected medical record.
16. Higher Self and Spiritual Guidance
Information experienced as coming from a Higher Self, guide, council, deceased loved one, spiritual being, energetic field, or other source remains part of the Client’s subjective spiritual experience.
The Practitioner acts as a facilitator and does not independently verify the identity, nature, authority, accuracy, or intention of any perceived source.
No spiritual message should be treated as an unquestionable command.
You remain solely responsible for interpreting session material and deciding whether or how to apply it. You agree to use personal discernment and seek appropriate professional advice before making significant decisions.
17. Third Parties
You may discuss relationships and other people during your session. The Practitioner has not evaluated those individuals and cannot verify statements or impressions concerning them.
Session content does not constitute a diagnosis, psychological assessment, factual determination, or authoritative statement about another person.
You agree to respect the privacy, autonomy, reputation, and legal rights of any third party discussed or perceived during the session.
18. Practitioner Boundaries and Right to Refuse Service
The Practitioner may decline, postpone, redirect, or terminate a session when:
A session terminated because of Client misconduct, intoxication, material nondisclosure, unsafe behavior, or violation of these Terms may be nonrefundable.
19. Personal Responsibility and Assumption of Risk
You understand that participation is voluntary and may involve emotional, psychological, spiritual, physical, technological, and privacy-related risks.
You accept responsibility for your participation, interpretations, choices, actions, decisions, and integration after the session.
You agree that the Practitioner is not responsible for decisions you make based upon session content or for consequences arising from your independent interpretation or application of that content.
20. Limitation of Liability
To the fullest extent permitted by applicable law, the Practitioner and Angels & Earthlings will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or connected to the session, recording, technology platform, interpretation of session content, or use of information received.
To the fullest extent permitted by law, the total liability of the Practitioner and Angels & Earthlings for any claim connected to the session will not exceed the amount you paid for the specific session giving rise to the claim.
Nothing in these Terms is intended to waive liability that cannot legally be waived or to exclude responsibility for gross negligence, intentional misconduct, or another obligation that applicable law prohibits the Practitioner from excluding.
21. Governing Law and Dispute Resolution
These Terms will be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
Before filing a legal claim, both parties agree to attempt in good faith to resolve the concern through written communication.
If the matter cannot be resolved informally, the parties agree to consider good-faith mediation before pursuing litigation.
Unless applicable law requires otherwise, any legal action concerning these Terms or the session will be brought in a court of competent jurisdiction located in Knox County, Tennessee.
22. Severability
If any part of these Terms is found invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary. The remainder of the Terms will continue in effect.
23. Entire Agreement
These Terms, together with the booking information, intake form, privacy disclosures, and any written policies presented at booking, constitute the entire agreement concerning the session.
Any modification must be made in writing. A failure to enforce one provision does not waive the right to enforce it later.
24. Electronic Acceptance
Checking the acknowledgment box, submitting the booking form, electronically signing, or completing payment constitutes your electronic acceptance of these Terms.
You confirm that you have had the opportunity to read the Terms before booking, save or print a copy, and ask questions before participating.
